BranchGPT uses third-party chat API providers to power its chatbot services. These providers handle the processing of user inputs and generate responses based on models we do not control. As such, we make no warranties, express or implied, regarding the accuracy, completeness, reliability, legality, or quality of any responses generated by the chatbot. The chatbot may provide inaccurate, misleading, incomplete, or harmful information, and you acknowledge that any use of this information is at your own risk.

We disclaim all liability for any direct, indirect, incidental, consequential, or punitive damages that arise from your reliance on the chatbot’s responses, including but not limited to personal injury, financial loss, legal issues, or harm resulting from inaccurate advice or actions taken based on the chatbot's information.

3.2. Content Responsibility
By using BranchGPT, you understand and agree that we do not monitor or verify the content generated by the chatbot. The information provided is not a substitute for professional advice (e.g., medical, legal, or financial advice). You should not rely on the chatbot's responses for any critical decisions or actions, and you are solely responsible for verifying the accuracy and suitability of the information for your specific circumstances.

4. Limitation of Liability
To the fullest extent permitted by law, BranchGPT and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of data or content (including chats),
Inaccurate or harmful information provided by the chatbot,
Personal injury or harm arising from chatbot responses,
Misuse of your account due to unauthorized access.
In no event will BranchGPT's total liability exceed the amount you have paid, if any, to use our services.

5. Disclaimers of Warranties
BranchGPT is provided on an "as is" and "as available" basis, without any warranties of any kind, express or implied. We do not guarantee that:

The App will function uninterrupted or error-free.
The chatbot will provide accurate or reliable information.
The App will be free from viruses or harmful components.
We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Data and Security
We take reasonable measures to protect your personal data and chat history, but you acknowledge that no method of data transmission or storage is 100% secure. While we employ access control measures and plan to implement encryption, we cannot guarantee absolute security of your data, and you agree to use the App at your own risk.

We are not liable for any unauthorized access to your data, chat history, or personal information, or any resulting damages from such access, including data breaches or hacking incidents.

7. Indemnification
You agree to defend, indemnify, and hold BranchGPT and its affiliates harmless from and against any and all claims, damages, losses, liabilities, costs, and expenses (including attorney fees) arising from:

Your use or misuse of the App,
Your violation of these Terms or any applicable laws or regulations,
Your reliance on any information provided by the chatbot,
Any claim or dispute between you and a third party related to your use of the App.
8. Termination
We reserve the right to suspend or terminate your access to the App, with or without notice, for any reason, including if we believe you have violated these Terms or engaged in any unlawful or harmful behavior.

Upon termination, your right to use the App will cease immediately, and we may delete your account and all associated data, including your chat history. We will not be liable for any data loss resulting from such termination.

9. Changes to These Terms
We may update these Terms from time to time. When we do, we will notify you by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

10. Governing Law
These Terms will be governed by and construed in accordance with the laws of EU, without regard to its conflict of laws provisions. Any disputes arising from or related to your use of the App shall be subject to the exclusive jurisdiction of the courts located in [Your Jurisdiction].
